Our Terms of Service

第１条（目的）

本規約は、株式会社フルーツフルイングリッシュ（以下、弊社という）が配信するメールマガジンへの読者登録を希望される方（以下、読者登録希望者という）及び読者登録を行った方（以下、登録読者という）に適用されるものとします。

Article 1 (Objective)

These terms apply to those who wish to subscribe to newsletters as well as those who have already subscribed to newsletters (hereinafter referred to as "Subscribers") distributed by Kabushiki Gaisha Fruitful English (hereinafter referred to as "Our Company").

第２条（定義）

本規約において、用語の定義は次のとおりとします。

メールマガジン　無料で定期または不定期に何らかの情報提供を目的として、あらかじめ受信を希望するものとして登録した読者に宛てて、弊社のサーバを通じて一斉配信される電子メール。

Article 2 (Definitions)

Terms specific to this document are defined as the following:
Newsletter: A free electronic mail that is distributed through Our Company's server at either regular or irregular intervals for the purpose of providing information to those who have registered as subscribers.

第３条（個人情報の取り扱い）

弊社は、登録読者のメールアドレスを、メールマガジン配信及び弊社からの連絡の目的でのみ使用します。
個人情報の取り扱いは、別途定める「プライバシーポリシー」に従います。

Article 3 (Handling of Personal Information)

Our Company only uses a subscriber's email address for the purpose of distributing our newsletters or communications from Our Company.
Personal information will be handled in accordance with the separately defined "Privacy Policy".

第４条（読者登録）

読者登録希望者は、所定のウェブページから自己のメールアドレスを送信することにより、読者登録を行うものとします。

Article 4 (Subscription)

Those who wish to become Subscribers shall register by submitting their personal email address on the designated web page.

第５条（その他メールマガジンへの読者登録）

弊社は、登録読者のメールアドレスを、当社が発行するその他のメールマガジンに同時又は事後に読者登録することがあります。

Article 5 (Subscription to Additional Newsletters)

Our Company may register a subscriber's email address for additional newsletters issued by Our Company at the time of initial registration or any time after the initial registration.

第６条（読者による読者登録解除）

登録読者がメールマガジン配信の停止を希望するときは、所定のウェブページから自己のメールアドレスを送信することにより、読者登録を解除するものとします。

Article 6 (Canceling Your Account)

If a subscriber wishes to stop receiving the newsletter, they may cancel their subscription by submitting their email address on the designated web page.

第７条（弊社による読者登録解除）

弊社は、次の各号のいずれかに該当する事由があると認めたときは、当該読者登録を解除することがあります。

  1. メールアドレスの誤り若しくは廃止、又はメールボックスの溢れ等により、配信したメールマガジンが不達となったとき。
  2. 登録読者側のメールサーバの受信拒否又は受信障害等により、メールマガジン配信に著しい障害があったとき。
  3. 第９条の禁止事項に該当する行為があったとき。
  4. メールマガジンが廃刊されたとき。
  5. その他読者登録を継続することが不適当な事由があるとき。

Article 7 (Termination of Your Account)

In the event of one of the following conditions being met, Our Company may terminate the subscriber's subscription.

  1. The newsletter is unable to be delivered due to an error in the email address, deletion of the email address, mailbox overflow, etc.
  2. The newsletter is unable to be delivered due to the subscriber's email server refusing or failing to receive the newsletter.
  3. The subscriber commits an act that is classified as prohibited as defined in Article 9.
  4. The newsletter is discontinued.
  5. There are other reasons that make continuing the subscription unsuitable.

第８条（メールマガジンの内容）

登録読者がメールマガジンで得た情報を利用するときは、それによって生じるすべての結果の責任を登録読者が負うものとします。

Article 8 (Newsletter Content)

When a subscriber uses the information gained from the newsletter, they shall become responsible for all consequences resulting from their use.

第９条（禁止事項）

読者登録希望者及び登録読者は、次の各号に掲げることを行ってはならないものとします。

  1. 他人のメールアドレスを読者登録すること。
  2. 不正に入手又は生成した大量のメールアドレスを読者登録すること。
  3. 弊社のサーバに対して不正アクセスを試みること、意図的に不正な指令を与えること及び高負荷をかけること、その他弊社のシステムに障害を発生させようとすること。
  4. 弊社の事前の許可なくメールマガジンの内容を公開すること。

Article 9 (Prohibited Acts)

Prospective Subscribers as well as Subscribers shall not do any of the following:

  1. Register with another person's email address.
  2. Register with an illegally obtained email address or with a large number of generated email addresses.
  3. Attempt to gain unauthorized access to our servers, attempt to give it illegal commands or place a heavy burden on it, or attempt to cause other system failures in our system.
  4. Make the contents of the newsletter public without Our Company's prior consent.

第10条（システムの停止）

弊社は、システムの保守のため、サービスの一部又は全部を一時停止することがあります。この場合、弊社は事前に読者登録希望者及び登録読者に対して告知するものとします。ただし、緊急を要する保守及び軽微な保守の場合は、この限りではありません。

弊社は、システム若しくは通信回線等の障害又は停電、騒乱、火災若しくは天災地変等の不可抗力によって、予告なくサービスの一部又は全部の提供を一時停止することがあります。

Article 10 (System Outage)

To protect our system, Our Company may discontinue a part or all of our services. In that case, Our Company shall give notice to prospective Subscribers and Subscribers. However, this does not apply in the event of urgent or minor maintenance.

第11条（弊社からの連絡及び告知）

弊社は電子メールの送信又は所定のウェブページ若しくはメールマガジンへの掲載によって、登録読者への連絡又は告知を行うものとし、これによって連絡又は告知事項が登録読者に到達したものとみなします。

Article 11 (Communication and Notices from Our Company)

Our Company may contact Subscribers by sending emails or posting on the designated web page or within our newsletter, and it will be assumed that the communication or notice has reached the Subscriber.

第12条（免責事項）

弊社は、登録読者が受けた次の各号の損害について、一切の責任を負わないものとします。

  1. 第７条及び第10条によって発生した損害。
  2. メールマガジンから得た情報を利用したことによって発生した損害。
  3. 弊社の責めによらない事由により、弊社からの連絡又は告知が登録読者へ伝わらなかったことによって発生した損害。
  4. 理由にかかわらず、メールマガジンの不配、未配、遅配又は誤配によって発生した損害。

Article 12 (Disclaimer)

Our Company is not responsible for any of the following:

  1. Damage caused by acts stated in Article 7 and Article 10.
  2. Damage caused by the use of the information gained from the newsletter.
  3. Damage caused by notifications and communications failing to reach the Subscriber due to reasons not attributable to Our Company.
  4. Damage caused by undelivered, unmailed, late, or misdelivered newsletters for any reason.

第13条（準拠法・合意管轄）

本規約の準拠法は日本法とします。また、弊社と利用者との間で生じた紛争については、弊社の住所地を管轄する裁判所を第一審の専属管轄裁判所とします。

Article 13 (Governing Law/Agreed Jurisdiction)

The governing law of this agreement shall be the law of Japan. In addition, the court having jurisdiction over the address of Our Company shall be the exclusive jurisdictional court of the first instance for disputes arising between Our Company and users.

第14条（規約の改定）

本規約は予告なく改定されることがあり、サービス利用時点での規約が適用されるものとします。（「個人情報の取り扱いについて」の項目は対象外とします）

Article 14 (Amendment of Terms)

These terms may be revised without notice and will be applied at the time of using our service. This does not apply to articles pertaining to the handling of personal information.

附則

  1. このメールマガジン読者利用規約は、2011年4月1日から実施します。

Supplementary Provision

  1. These terms of use for newsletter Subscribers will be enforced from April 1, 2011.
